Grief manifests itself in many ways and can fracture relationships. Where this happens, it is common for disputes to arise between family members who are often also executors, beneficiaries and disappointed beneficiaries. This is particularly the case during the administration of their loved one’s estate. Common disagreements include for example, who should benefit from their loved one’s estate and whether or not a particular disposal from the estate has been appropriate.
Equally it may be the case that family members have been pulled together, but their loved one’s Will has gone missing or they did not have a Will at all. These situations can make it fundamentally more difficult to administer the estate.
We can provide advice in a variety of matters, including:
- legal and prior rights claims
- challenging a Will
- executor disputes
- professional negligence of executor or solicitor
- proving the tenor of a lost Will
- disputes in relation to intestate estates
- contentious guardianships
- recovering debt from a deceased’s estate
