Using alternative dispute resolution to avoid litigation
With all family disputes, we try to avoid the expense and acrimony of going to court. Instead, we usually recommend “alternative dispute resolution”, for example:
- Negotiation directly with the other party or via solicitors
- Family mediation, using a trained mediator who reduces conflict and helps you reach a solution
- Collaboration, with four-way meetings between clients and solicitors, and a commitment to avoiding litigation
- Arbitration, where a legally trained solicitor/ advocate decides on the dispute, without it going to court.
