Dealing with separation, divorce and contact with children: Practical advice from a family lawyer
As we move into a new year, many people find themselves reflecting on their relationships and making difficult decisions about their future. If you’re in that situation, it’s important to remember that you’re not alone - and there are ways to navigate these challenges with clarity and care. Productive communication and a goals-based approach can make a world of difference during what is undoubtedly a tough time.
Why communication matters
One of the best ways to minimise stress - and costs - is through open and constructive dialogue. Particularly when children are involved, the more certainty and structure you can bring to the situation, the better it is for everyone. Clear communication helps to reduce misunderstandings and can pave the way for more amicable agreements. It is important for us at the outset, and throughout assisting clients with a separation, to establish their goals from the process, what is of most importance to them and their families for the future.
I’ve found that effective negotiation often resolves disputes without the need for court action. This doesn’t just save time and money - it also helps those relationships which continue beyond separation. This is especially important if couples are to co-parent, in whatever form they decide this should take.
Support tailored to your needs
No two cases are the same. Whether you’re dealing with a divorce, separation, or a dispute involving child contact, the approach we take will depend on your specific circumstances.
Family law is ultimately about helping people. The work we do has a profound impact on the lives of our clients, and that’s something I’m deeply passionate about. People often turn to us during times of real upheaval, and it’s our job to provide clarity and guidance.
When children are involved, finding arrangements that work is particularly important. People could be co-parenting for many years, so setting a strong foundation early on is key. Cases where couples can communicate respectfully often achieve the most satisfactory outcomes for everyone involved.
Recognising the impact of trauma
In my work, I’m particularly mindful of the impact trauma can have on clients. As one of the first solicitors in Scotland to be a certified Trauma Informed lawyer, I have received Law Society of Scotland training to understand and respond to the ways in which past experiences may affect the decisions you’re facing now. This perspective shapes the way I approach every case, ensuring that support is tailored to meet not only your practical needs but your emotional ones too.
Remember, you don’t have to face this alone. We will guide you toward the best path forward, whether through collaboration, negotiation, arbitration, or, if necessary, court action. By taking a thoughtful and informed approach, you can move forward with confidence toward a positive future.
