When professional advice does not meet expected standards
Each day of our lives, whether it is as a consumer or in the course of our working day, we have to deal with professional advice. We may be asking for it or we may be providing that advice. Unfortunately, from time-to-time, a situation will arise where we may feel that the professional advice or services provided does not match the standard that we expect or, alternatively, we face the accusation that we have failed in our duties in providing such advice or services.
Seek objective legal advice
In such a situation, whether you are the recipient or provider of professional services, it makes sense that you should seek your own professional advice on how to deal with the situation that has arisen. It is not always an easy matter to identify whether or not professional negligence has taken place. The fact that someone may have got something wrong or the outcome of seeking advice was not what was sought or expected does not necessarily mean that someone has been negligent. Objective legal advice on your rights or obligations is critical in these situations.
It is never too early to seek advice and it may be that all that is required is reassurance. On the other hand early intervention in a case where there has been negligence may provide the route to a significant level of damage limitation. From architectural disasters to failed medical treatment and conveyancing transactions, our team can assist you in finding a resolution.
Here are a few examples of problems potentially giving rise to professional negligence claims arising from contractual relationships:-
- Problems arising from a failure to register a standard security;
- The consequences of failure to raise Court Proceedings within relevant time limits;
- The consequences of a failure to lodge a licensing application in compliance with time limits;
- The consequences of failing to serve rent review or other notices arising in commercial letting situations in the correct form or within the correct timeframe;
- Problems in obtaining completion certificates in building contracts;
- The emergence of structural issues in building contracts;
- Problems with the submission of required documents, eg annual returns, to Companies House
Personal Injury claims
Other relationships may give rise to claims for personal injury where our Personal Injury team (see our Calio Claims website here) can advise on how to deal with claims involving, for example, medical negligence by doctors, dentists and other healthcare professionals.
