Expert determination can be useful to investigate the background to a dispute if it involves a technical issue, and also when a quick decision is required.
Our specialist dispute resolution team can guide you through the process involved, and advise you on whether this is likely to yield the best results for your business.
How does the process work?
An expert in the specific technical field is engaged by the parties, and they agree to be bound by the expert’s decision.
The expert is not restricted to relying upon the evidence that the parties might choose to present, and such determinations are usually structured in such a way that the outcome is not subject to any appeal to the courts.
Although this process can create finality, it can also mean that there is a risk of having no redress if the expert does happen to get it wrong.
